Terms of Sales

Any order implies the 100% acceptance by the Customer and his full and entire adhesion to the general conditions of sale below. These prevail over all other conditions of the Customer, and especially on all the general conditions of purchase.

Definition:

e-learning module: an interactive training module with general content, that is made available in DL (Distance Learning) via the Internet, on the IBC Paper Training platform.

Tailor made e-learning module: an interactive training module whose content is custom-made, by adapting it to the factory process and which can be made available in DL (Distance Learning) via the Internet, on the IBC Paper Training platform or via another way of access of the client.

Subscription web series: Subscription in which videos of presentations of experts “Live” and in “Streaming“, at “Expertise” level, are made available in DL via Internet to its subscribers.

Intra-company training (on-site): Customized and delivered training, on behalf of a customer, face to face, on site.

Inter-company training: Training developed according to a program created by IBC Paper Training, in relation with the important themes of the Industry, and delivered face-to-face in spaces rented by IBC or via web conference.

 

e-learning module:

Provision of modules: The modules corresponding to the order will be made available to the customer on the platform within 72 hours, after acceptance and payment of the order.

Access to the modules: a log-in and a password will be created according to the information provided by the customer (last name, first name and email) and will be communicated to the customer. The username and password is exclusively personal, confidential and can not be transmitted or lent.

Minimum requirements for accessing modules in good working state: the e-modules work on any computer connected to the Internet with a minimum of 20MB bandwidth (ask again), the updated Internet Explorer browser and Flash Player updated . Other browsers or other means, such as smartphones or tablets can be used, but the proper functioning of e-modules is not guaranteed.

Responsibility: The customer is responsible for the proper storage and use of his username and password. IBC Paper Training can not be held responsible for any fraudulent use of the username or password. The customer undertakes to inform IBC Paper Training immediately if he finds fraudulent use.

Duration of access to the modules: The access to the e-modules is valid for 48h after the 1st connection during 1 month from the day when the log-in and password were sent. After 1 month or 48h used, the access will be cut off and the customer will have to make another order. The access is available 24 hours a day, 7 days a week.

Associated services: The access to e-modules includes in addition to the provision of modules in good working order, maintenance of the platform and user assistance via an email within 48 hours. 

Copyright protection: The digital content of the e-learning modules, as well as all the elements of the website are protected by the intellectual property code and by the applicable international standards. All content of the e-learning modules belong exclusively to IBC Paper Training. It is strictly forbidden to reproduce, copy, record, deform, use, distribute, adapt and modify these contents, under penalty of criminal prosecution.

Training duration of e-modules: The durations indicated are average times for browsing the quizzes and the e-module. Some learners will have faster progression times and others will be slower and will come back to explanations several times. In none of the cases IBC Paper Training can be implicated for a duration of course different from the one indicated.

 

Tailor made (e-learning) solution:

Tailor made solution not containing customized e-learning modules : Intra-company training

A commercial and financial proposal corresponding to the needs of the customer will be proposed to him. This proposal, once accepted, the customer will pay an advance payment of 10% when placing the order.

The remaining amount will be due in parallel with the progress of the training, on the invoice.

Expenses related to the travel and accommodation of the trainer(s) will be supported by the customer at actual costs, upon presentation of invoice. If trips are made by car, the km will be reimbursed up to 0.675 Euros / km.

It is possible to replace one learner with another by communicating it to IBC Paper Training at least 5 working days before the training session.

Tailor-made solution containing customized e-learning modules :

A commercial and financial proposal corresponding to the needs of the customer will be proposed to him. This proposal, once accepted, the customer will pay an advance payment of 40% when placing the order, then 30% at the middle of the training and 30% at the end of the training.

Module creation requirements: In order to create the tailor made modules, IBC developers / trainers will spend time in the factory collecting all the information needed for the successful development of the e-modules. It will take a minimum of time indicated in the proposal after the immersion in the plant by the IBC team, for the development of the e-module. Once the module has been developed, IBC Paper Training will send the e-module for review to the customer, who will have to communicate the modifications to be done by IBC Paper Training within 2 weeks maximum. IBC Paper Training commits itself to make modifications only once after communication of these modifications within the time limit of 2 weeks. After this time, IBC Paper Training will not make any other changes and will deliver the e-module as it is, without any possibility of complaint from the client.

Confidentiality: IBC Paper Training undertakes to keep all information collected in the factory strictly confidential and not to distribute or use it (other than for the creation of your e-modules) under any pretext. A confidentiality agreement can be signed between IBC Paper Training and the customer.

Copyright protection: The digital content created, resulting from the information collected at the customer, belongs solely and exclusively to the customer.

However, digital content from IBC Paper Training’s general content database (such as 3D animations, diagrams, etc.) found in the custom modules can only be used for what they were sold, ie train the learners by following the e-module. The customer can not isolate, copy, modify, or resell these contents under any pretext, under penalty of criminal prosecution.

Sale without provision of modules on our platform: The modules are delivered in good working order on a specific browser. Then, the customer is fully responsible for the access of his learners to the e-module and IBC Paper Training can not be held responsible for any malfunction of the e-module. Given the speed of internet changes, if the e-module needs changes over time, IBC Paper Training, in good agreement, can make these changes based o a quotation.

Sale with the provision of the e-modules on our platform: The modules are delivered in good working order to the customer. In addition to delivery, the e-module is hosted on the IBC Paper Training platform and access is given to learners via log-ins. The number and duration of the access is based on the commercial and financial proposal. Access is available 24 hours a day, 7 days a week

Given the speed of internet changes, if the e-module needs changes over time, IBC Paper Training, in good agreement, can make these changes based on a quotation.

Subscription to the web series:

Conditions of the subscription: The subscription, after payment of the order, gives right to 1 open license per site of production for a duration of one year. The subscription is renewable automatically every year.

The licenses per production site are personal to the production site and can not be loaned or given to other production sites under penalty of prosecution and request for payment of a subscription surplus corresponding to the number of sites that benefit from these licenses.

The subscription gives access to 9 LIVE and Streaming presentations per year. In addition to these videos, the web series will keep up to 2 years minimum the videos that will be available in the web series, with the exception of the launch of the web series in April 2018 when IBC Paper Training will make available 9 videos in advance.

Live presentations will be accessible via web conference, with a platform of our choice, on which the audio is done via the computer once a month. If it turns out that the customer does not hear and must go through the phone, this will be billed to the actual costs on the invoice.

Streaming access: The videos of the LIVE presentations and tips are accessible at all times and require a minimum of Internet connection (read a video of 70 min.), for which IBC Paper Training can never be blamed if the customer does not succeed to play the videos due to connection problems. Access is available 24 hours a day, 7 days a week

Program: IBC Paper Training establishes a program for the coming year, with various themes different the ones from another. IBC Paper Training reserves the right to change a few topics, or the expert trainer, with the condition to inform the client about it 5 working days before the LIVE presentation.

Copyright protection: IBC Paper Training has the right to broadcast the presentations, however the copyright belongs exclusively to the expert of the presentation and can not be copied, modified, disseminated, sold and used under penalty of penal sanctions.

Inter-company training

Program: IBC Paper Training establishes a program with experts as lecturers on a theme related to the Paper Industry. IBC Paper Training reserves the right to change the trainer expert, provided that he informs the client 5 working days before the training.

Duration: The trainings are usually held during 2 or 3 days, depending on the program.

Registrations are made via internet and must be paid before the training.

Substitution: A participant, already registered, can be replaced by another participant, provided that IBC Paper Training is informed 5 working days before the training.

 

Price :

Price: e-modules, the Tailor made solution: based on a quotation, the web series, the inter-company training

Price of e-modules: The price is the one indicated on the website. The price is valid for 48h after the first connection for a log-in for one person for one module during one month .

Price of the solution with or without customized e-module: The price is the one indicated in the commercial and financial proposal.

Subscription price of the web series: The price of the subscription is the one indicated on the Internet site. The subscription is valid for 1 year for 1 license for 1 production site.

Price of the registration to inter-company trainings: The price of the subscription is the one indicated on the Internet site. Registration is valid for 1 person for the duration of the training. This price includes the participation to the training, lunch and breaks. This price does not include travel or accommodation costs.

 

Cancellation by the client:

e-modules: After payment of the order there is no possibility of cancellation. The log-in and password will be communicated and access will be given for one month.

Customized solution: the cancellation conditions are those indicated on the commercial and financial proposal.

Special conditions for tailor-made solutions without e-learning modules: All intra-company training that has started, is due in full. For all intra-company training canceled within 10 working days, the price of the training will be due at 50% of the amount, as well as the reimbursement of expenses already occurred.

Subscription to the web series: After payment of the order there is no possibility of cancellation. Licenses will be available for one year.

Registration for an inter-company training: For all cancellations 6 weeks before the first day of training, the total price of the training will not be due and can be refunded. For cancellations less than 6 weeks before the first day of training, the price of the training will be due at 50% of the price of the registration. Once the training has begun, there is no possibility of reimbursement.

 

Payment Terms:

e-module: Payment is made upon registration via the website via PayPal by credit card.

Web series: Payment is done at registration via the website via PayPal by credit card. The subscription is done once a year and is tacitly renewed every month.

Tailor made solution: The payment is made by bank transfer according to the conditions described in “tailor-made e-learning solution”. Special conditions: Payment period: Invoices are payable in Euros, within 30 days from the date when the invoice was issued. In accordance with the laws n ° 2001-420 of May 25th, 2001, in case of exceeding the deadlines of payment, IBC Paper Training reserves the right to claim a compensation of 1.5% per month of delay.

Inter-company training: Payment is done at registration via the website via PayPal by credit card. Payment must be made before the first day of the training.

 

VAT:

Prices are quoted in Euros and excluding taxes. VAT must be added to these prices according to the rate in effect 

If you are a French company subject to VAT, the VAT of 20% will be applied on all indicated prices.

If you are a European company, not French, and you have an intra com number, then the 20% VAT will not be applied on the indicated prices.

If you are a company outside the European Union, the VAT of 20% will not be applied on the indicated prices.

If you are not a company, in all cases, the 20% VAT will be applied to all listed prices.

Payment by a sponsoring organism

If the customer wishes to pay using a sponsoring organism (for example, OPCA as define under the French Law), IBC will establish a convention once we have received the registration that will be signed by both parts. The payment procedure stays the same as described above in the general conditions. At the end of the Training, IBC will provide administrative papers to the customer needed to be entitled to the sponsoring such as attendance sheet or other

Order acceptance: Inter-company training: IBC reserves the right to refuse an order if it is in competition with one of our lecturers.

 

Cancellation by IBC Paper Training:

Inter-company training: IBC reserves the right to cancel the training due to lack of participants until 4 weeks before the first day of the training for face-to-face training and up to 1 week before the first training session for the training in web conference.

 

Computer data and Freedoms :

The information and data concerning the customer are necessary for the management of his order. In accordance with the Data Protection Act of January 6, 1978, amended in 2004, the customer has a right to access, rectify or oppose data concerning himself. This right can be exercised by sending an email request to IBC Paper Training.

 

Attribution of competences :

The French law is the only one applicable. In case of translation of these, the French version predominates.

 

Technical malfunction :

For e-modules, tailor made e-modules hosted on our platform and the web series: The Company undertakes to remedy any technical malfunction within 24 hours. After this period of time, the Company will extend the duration of the access to the module for a period corresponding to the period of unavailability.

The Company can not be held responsible for connection difficulties in the case of an interruption in the internet access or connection interruption, in particular due to:

a case of force majeure, power outages, interruptions related to service providers, hosts and access providers.
